NEW EXECUTIVE ORDER CREATES ELIGIBILITY FOR ADJUSTMENT OF STATUS FOR THOSE WHO CROSSED THE BORDER

According to the US Department of Homeland Security’s announcement, USCIS will start accepting applications for discretionary grants of parole to persons who entered the US without a visa.  The program will begin August 19, 2024.

Individuals who crossed the border with no visa may be eligible to apply for this benefit.  It would lead to eligibility for adjustment of status to permanent resident in the United States.  However, the person must have lived in the US for 10 years as of June 17, 2024; must have a legally valid marriage to a US citizen as of June 17, 2024; and must not have any disqualifying criminal convictions.

USCIS can grant this parole as matter of discretion.
